			<content:encoded><![CDATA[<p>Iata un concurs pe care l-am gasit interesant si care promoveaza ideea unei Europe unite in diversitate.</p>
<p><span style="color:#ff0000;">CONCURS FOTO &#8220;Unitate in diversitate&#8221; </span></p>
<p><span style="color:#003300;">Participa la un proiect international, exprima-ti viziunea  si castiga 100 euro !    Diferente etnice, nationale, religioase, sexuale, sociale, economice, culturale, geografice. Diferente de gust, de stil, de viziune, de temperament. Ce-i de facut cu diferentele? Unii le detesta si le resping, altii le ignora, putini le accepta, iar si mai putini le unesc si le integreaza.   Ne-am gandit ca atunci cand surprinzi diferentele si poti intui un liant care le aduce laolalta intr-un tot unitar, sa nu treci mai departe, ci sa te opresti pentru o clipa si sa surprinzi scena cu aparatul tau de fotografiat. Ne dorim să promovăm viziunile tinerilor în ceea ce priveşte diversitatea, într-un mod creativ, original.   “Unitate in diversitate” nu este doar motto-ul UE, ci ar trebui sa fie un principiu inteles si aplicat de fiecare dintre noi in viata de zi cu zi! Prin acest concurs foto, Asociatia pentru Integrare Europeana Quiz, organizatie non-guvernamentala de tineret, te invita sa celebram impreuna diversitatea !   Concursul va fi jurizat de persoane cu experienta in fotografie si design, initiatori ai proiectului “Camera Obscura”, revista online de fotografie. Cea mai interesanta poza va fi premiata cu 100 euro; in plus, multor participanti li se vor expune fotografiile in cadrul unei expozitii foto in Izmir , Turcia (mai 2009).   Acest concurs face parte din proiectul internaţional “Networking Europe”, co-finanţat de Uniunea Europeană şi implementat de patru organizaţii din România, Turcia, Spania şi Italia. Initiativa urmareste in principal promovarea Uniunii Europene in randul tinerilor turci, dar si crearea unor legaturi durabile si productive intre sectoarele non-guvernamentale din tarile membre si non-membre UE. 			<content:encoded><![CDATA[<p style="margin-bottom:0;" align="justify"><img class="alignleft" style="float:left;" src="http://europa.eu/abc/symbols/motto/images/motto.gif" alt="" width="288" height="230" /><span style="font-size:small;">L&#8217;Unione Europea vive oggi una fase particolare. Alcuni Stati dell&#8217;Unione, in toni e comportamenti differenti (es. Grecia, Italia, Spagna), in nome di una loro autodeterminazione, mettono in discussione alcuni istituti giuridici comunitari. Si pensi come spesso gli stessi cittadini europei siano trattati come non-cittadini nei differenti Stati dell&#8217;Unione quando, taluni, compiono atti criminosi. Da ciò nasce l&#8217;esigenza di interrogarsi, per chi si ritiene “europeo”, sui temi dell&#8217;identità e della cittadinanza, della Nazione e della Comunità Sovra-Nazionale.</span></p>
<p style="margin-bottom:0;" align="justify"><span style="font-size:small;">Questo breve postit vuole essere una riflessione ed insieme uno stimolo verso chi pensa utile aprire tale dibattito per consolidare e accrescere la costruzione dell&#8217;Unione Europea, per raggiungere, cioè, quello che Rifkin (2004) ha definito come il <em>Sogno Europeo</em> ed evitare la <em>Retorica</em> dell&#8217;Unione (Wallerstein, 2006), in cui si parla molto di <em>cittadinanza, </em>ad esempio, ma che poi difficilmente si concretizza in azioni politiche e sociali uniformi ed incisive.</span></p>

<p style="margin-bottom:0;" align="justify"><span style="font-size:small;"><em>La storia di un concetto&#8230;</em></span></p>
<p style="margin-bottom:0;" align="justify"><span style="font-size:small;">Nella storia politica e sociale dell&#8217;Età moderna un concetto più di tutti sembra aver caratterizzato la novità del tempo: la “cittadinanza”.</span></p>
<p style="margin-bottom:0;" align="justify"><span style="font-size:small;">Fino al 1789 (data simbolo per la modernità) l&#8217;idea di cittadinanza era inesistente, più congeniale all&#8217;<em>Ancien Régime</em> era il concetto di “nazione”, etimologicamente legato all&#8217;idea di <em>luogo di nascita</em><span style="font-style:normal;"><span>,</span></span><span style="font-style:normal;"> e di “popolo”. L&#8217;equazione Stato = Popolo = Nazione, costituiva nel pre-moderno l&#8217;assioma politico e sociale che permetteva di tenera unita una entità statuale territorialmente definita. Come notano, però, Hobsbawm (1990) e Gellner (1983), anche questa equazione risulta quale processo di una più o meno lunga costruzione sociale di una identità politico-sociale voluta, coscientemente o meno, dalle forze sociali che hanno spinto alla sua edificazione in rapporto alla sempre più forte presenza del nascente sistema economico di tipo capitalista che andava consolidandosi dalla metà del Quattrocento (Wallerstein, 1974).</span></span><span id="more-17"></span></p>
<p style="margin-bottom:0;" align="justify"><span style="font-size:small;"><span style="font-style:normal;">L&#8217;assioma dell&#8217;</span><em>Ancien Régime</em><span style="font-style:normal;">, tuttavia, poco si adattava ad un mondo in cui la circolazione delle merci, degli uomini e la pluralità di pensieri ed idee (per lo più religione al tempo) spezzavano la presunta unità per cui, in ogni Stato, esisteva un solo Popolo, con una sola lingua, una sola religione, etc&#8230;, tanto da costituire la garanzia dell&#8217;unità e della pace interna. Tralasciando i momenti sociali e gli eventi storici in cui l&#8217;idea di “cittadinanza” e di “cittadino” si sono venuti a crearsi in Europa, possiamo ricordare, tuttavia, come tale termine sia legato strettamente alla “città”, luogo che per l&#8217;Europa ha sancito, in tempi e modi diversi, la costruzione di una libertà laica e secolare in cui ci concretizzava una comunità di soggetti legati da vincoli giuridici indipendentemente dalla propria lingua e cultura che ha permesso, nei secoli, di accrescere la ricchezza del patrimonio socio-culturale che oggi l&#8217;Europa vanta (Pirenne, 1925). L&#8217;idea di cittadino è perciò legata a una concezione non-metafisica, ma giuridica di soggetto agente che ha diritti e doveri entro un quadro di democrazia.</span></span></p>
<p style="margin-bottom:0;" align="justify"><span style="font-size:small;"><span style="font-style:normal;">La storia europea, tuttavia, ci ha insegnato come la stessa idea di cittadinanza sia stata successivamente utilizzata insieme a quella di Nazione, perdendo l&#8217;originale senso di libertà e universalità, per diventare aspetto giuridico di una visione ristretta di “cittadino”.</span></span></p>
<p style="margin-bottom:0;" align="justify"><span style="font-size:small;"><span style="font-style:normal;">L&#8217;età moderna, infatti, inizia sì con la </span></span><em>Déclaration des Droits de l&#8217;Homme et du Citoyen </em><span style="font-size:small;"><span style="font-style:normal;">durante la Rivoluzione Francese, ma pone subito questo diritto entro uno Stato Nazione; uno Stato che riconosce sì le differenze e i diritti, ma che, durante tutto l&#8217;Ottocento, prova a controllare tale divergenza entro una Nazione, cioè entro un quadro linguistico, normativo e religioso pressoché unitario. Emblematici sono i casi della Germania e dell&#8217;Italia, una pluralità di Stati e Regni (spesso piccolissimi) che nella seconda metà dell&#8217;800 si ritrovano a essere riunite sotto un unico Stato, liberale nell&#8217;ispirazione – quindi moderno – ma standardizzante ed omologante nella sua struttura statale.</span></span></p>
<p style="margin-bottom:0;font-style:normal;" align="justify"><span style="font-size:small;">In questo caso sembra calzante l&#8217;affermazione di Hermann Kantorowicz (1877-1940) secondo il quale è più facile che vivano tanti popoli in un Impero che in uno Stato Nazione.</span></p>
<p style="margin-bottom:0;font-style:normal;" align="justify"><span style="font-size:small;">In breve, nell&#8217;Europa moderna, il concetto di cittadinanza, nei fatti, è sempre stato legata all&#8217;appartenenza identitaria dei diversi cittadini con la Nazione; in ciò si evince come la prima difficoltà che l&#8217;UE ha dovuto affrontare è stata quella di coniugare tale tradizione con quella del dello stato di diritto dell&#8217;universalità di un istituto giuridico come quello della cittadinanza.</span></p>
<p style="margin-bottom:0;font-style:normal;" align="justify">
<p style="margin-bottom:0;" align="justify"><span style="font-size:small;"><em>L&#8217;Europa che ci prova&#8230;</em></span></p>
<p style="margin-bottom:0;font-style:normal;" align="justify"><span style="font-size:small;">Da quanto si è sostenuto, emerge con chiarezza come lo statuto giuridico più importante per la UE sia la definizione di una Costituzione che abbia al suo interno, non dei riferimenti di tipo storico-religiosi (come spesso vorrebbero le differenti Chiese) quanto un richiamo al principio del diritto di matrice illuminista, in cui non solo l&#8217;idea di cittadino non può essere legata all&#8217;appartenenza religiosa, ma  men che meno al riconoscimento di una sola lingua o di un gruppo di lingue nazionali che possano assurgere a espressione dominante del pensiero degli europei.</span></p>
<p style="margin-bottom:0;font-style:normal;" align="justify"><span style="font-size:small;">E&#8217; quindi naturale che nella Costituzione il Titolo V parli della cittadinanza, tema estremamente importante in una entità politica composta da molti Stati-Nazione; esso sancisce, tra l&#8217;altro, il diritto di circolare e di soggiornare liberamente nel territorio dei paesi europei.</span></p>
<p style="margin-bottom:0;font-style:normal;" align="justify"><span style="font-size:small;">Risulta evidente che in un contesto come quello della UE i problemi solo estremamente collegati a quello della costruzione di una società multiculturale (con più religioni, più lingue, etc&#8230;). </span></p>
<p style="margin-bottom:0;font-style:normal;" align="justify"><span style="font-size:small;">Le sfide che l&#8217;Europa, pertanto, si trova ad affrontare solo pertanto legate alla costruzione di una società multiculturale all&#8217;interno di una concezione del diritto prettamente occidentale e di Stato di diritto. I dibattiti su questo tema sono molteplici, si considerino, solo a titolo esemplificativo quanto sostenuto da autori come Habermans (Habermas, 1999; Habermas J., Taylor, 1998 ) o dal recente volume collettaneo curato da Pompeo (2007).</span></p>
<p style="margin-bottom:0;font-style:normal;" align="justify"><span style="font-size:small;">In genere emerge come il multiculturalismo possa essere <em>una </em>soluzione ma non <em>la </em>soluzione. E&#8217; necessario, come lo stesso Le Goff (2001) sostenne qualche tempo fa, la costruzione di una cultura europea comune che è ancora da inventare, partendo dalle basi storiche, culturali e sociali dell&#8217;Europa. Cosa non facile e non agevole, se solo si considerano le molteplici forme di società e culture di cui è composta l&#8217;Europa. Tuttavia, lo storico francese, non pensa a una sintesi dialettica, potremmo dire, quanto alla sopravvivenza e prosperità delle molteplicità, tanto da pensare che ogni lingua del continente debba essere lingua dell&#8217;Europa, pur se non mette in dubbio &#8216;utilità di una o due forme linguistiche più diffuse. </span></p>
<p style="margin-bottom:0;font-style:normal;" align="justify"><span style="font-size:small;">In Europa, pertanto, cittadini si è solo in quanto è riconosciuto uno stato giuridico, certo, ma per evitare che questo sia solo un freddo strumento di una entità politica sovra-nazionale, ha bisogno del cuore e della passione della cultura, della storia comune, della conoscenza reciproca. E&#8217; per questo che siamo in piena “European building”, così come lo erano gli Stati Nazionali dell&#8217;800.</span></p>
<p style="margin-bottom:0;font-style:normal;" align="justify"><span style="font-size:small;">In questo lavoro gioca un ruolo importante la scuola e l&#8217;università (si pensi ai progetti Erasmus). L&#8217;identità europea e la cittadinanza europea dovrebbero essere argomento di insegnamento in tutta l&#8217;Unione, come sostiene Ohlendorf (1998), per cementare e costruire il sentimento europeo.</span></p>

			<content:encoded><![CDATA[<h3 style="text-align:justify;"><span style="color:#800080;"><span style="text-decoration:underline;">Cetăţenia europeană</span><strong> a fost definită prin Tratatul privind Uniunea Europeană, semnat în 1992, la Maastricht, şi intrat în vigoare în 1993. Incluzând drepturi, obligaţii şi participarea la viaţa politică, cetăţenia europeană vizează consolidarea imaginii şi a identităţii Uniunii Europene şi implicarea mai profundă a cetăţeanului în procesul de integrare europeană.</strong></p>
<p><strong>Articolul 17 al Tratatului de instituire a Comunităţii Europene prevede că este cetăţean al Uniunii Europene orice persoană care are naţionalitatea unuia dintre Statele Membre, conform legilor în vigoare în statul respectiv. Cetăţenia Uniunii Europene nu înlocuieşte însă cetăţenia naţională, ci vine în completarea cetăţeniei naţionale, făcând posibilă exercitarea unora dintre drepturile cetăţeanului Uniunii pe teritoriul Statului Membru în care locuieşte.</strong></p>
<p><span style="color:#800080;"><strong>Cetăţenia europeană are la bază principiile comune ale Statelor Membre: </strong></span></p>

<h3 style="text-align:justify;"><span style="color:#800080;">-<strong>principiul libertăţii, </strong></span></h3>
<h3 style="text-align:justify;"><span style="color:#800080;"><strong>-principiul democraţiei,</strong></span></h3>
<h3 style="text-align:justify;"><span style="color:#800080;">-<strong>principiul respectării drepturilor omului şi al libertăţilor fundamentale, </strong></span></h3>
<h3 style="text-align:justify;"><span style="color:#800080;"><strong>-principiul statului de drept </strong></span></h3>
<h3 style="text-align:justify;"><span style="color:#800080;"><strong> şi decurge din drepturile fundamentale ale omului şi drepturile specifice acordate cetăţeanului european (drepturi de liberă circulaţie şi drepturi civice), descrise în Tratat.</strong></span></h3>
<h3 style="text-align:justify;"><span style="color:#800080;"><strong><br />
Tratatul de la Amsterdam, intrat în vigoare la 1 mai 1999, a consolidat protecţia drepturilor fundamentale, condamnând orice formă de discriminare, şi a recunoscut dreptul la informaţie şi protecţia consumatorilor.</strong></span></h3>
<h3 style="text-align:justify;"><span style="color:#800080;">Cetăţenia Uniunii Europene oferă drepturi cetăţenilor statelor membre şi consolidează protecţia intereseloracestora:</span></h3>
<h3 style="text-align:justify;"><span style="color:#800080;">- dreptul la libera circulaţie, </span></h3>
<h3 style="text-align:justify;"><span style="color:#800080;">- dreptul de sejur, </span></h3>
<h3 style="text-align:justify;"><span style="color:#800080;">- de stabilire, </span></h3>
<h3 style="text-align:justify;"><span style="color:#800080;">- dreptul la muncă şi studiu în celelalte state membre ale Uniunii. </span></h3>
<h3 style="text-align:justify;"><span style="color:#800080;"> </span></h3>
<h3 style="text-align:justify;"><span style="color:#800080;">- dreptul de a alege şi de a fi ales în Parlamentul European şi în cadrul alegerilor locale în statul de rezidenţă, în aceleaşi condiţii cu cetăţenii statului respectiv;</span></h3>
<h3 style="text-align:justify;"><span style="color:#800080;">- dreptul de a beneficia pe teritoriul unui stat terţ (stat care nu este membru al Uniunii Europene) de protecţie consulară din partea autorităţilor diplomatice ale unui alt Stat Membru, în cazul în care statul din care provine nu are reprezentanţă diplomatică sau consulară în statul terţ respectiv;</span></h3>
<h3 style="text-align:justify;"><span style="color:#800080;">- dreptul de petiţionare în faţa Parlamentului European şi dreptul de a apela la Ombudsmanul European pentru examinarea cazurilor de administrare defectuoasă din partea instituţiilor şi organismelorcomunitare. Prin Tratatul de la Amsterdam, semnat în 1997 şi intrat în vigoare în 1999, statutul de „cetăţean european” include, în plus, următoarele drepturi:</span></h3>
<h3 style="text-align:justify;"><span style="color:#800080;">- dreptul de a se adresa instituţiilor europene într-o limbă oficială a Uniunii Europene1 şi de a primi un răspuns redactat în aceeaşi limbă;</span></h3>
<h3 style="text-align:justify;"><span style="color:#800080;">- dreptul de acces la documentele Parlamentului European, ale Consiliului şi ale Comisiei Europene, înanumite condiţii;</span></h3>
<h3 style="text-align:justify;"><span style="color:#800080;">- dreptul de nediscriminare, pe bază de naţionalitate, sex, rasă, religie, dizabilitate, vârstă sau orientare sexuală, între cetăţenii Uniunii;</span></h3>
<h3 style="text-align:justify;"><span style="color:#800080;">- dreptul de acces egal la funcţia publică comunitară. Comisia Europeană, care are rolul de a veghea la respectarea Tratatului, supraveghează aplicarea prevederilor legate de cetăţenia europeană şi elaborează rapoarte periodice.</span></h3>
<h3 style="text-align:justify;"><span style="color:#800080;">Constituţia României, modificată prin referendum, în contextul aderării României la NATO si UE, a introdus articolul 145-1, &#8220;Integrarea în Uniunea Europeană&#8221;, care prevede în alineatul 2 următoarele: &#8220;ca urmare a aderării, prevederile tratatelor constitutive ale Uniunii Europene, precum şi celelalte reglementri comunitare cu caracter obligatoriu au prioritate faţă de dispoziţiile contrare în legile interne, cu respectarea prevederilor actului de adeziune&#8221;.</span></h3>

<h3 style="text-align:justify;"><strong><span style="color:#800000;">We&#8217;ve been lucky to be able to find out more about the concept of European Citizenship and it would be amazing if we could share it with as many people as possible. That is why I would like to ask you to disseminate the information you received during the training course in Bonn by writing a short article in your own language dealing with the most important aspects that have been discussed there. Making the information available in as many languages as possible is also a way of being active in this field.</span></strong></h3>
<h3 style="text-align:justify;"><strong><span style="color:#800000;">You can also post photos, drawings or any other materials you may find useful in making the readers acquainted with both the concept under discussion and our work in Bonn.</span></strong></h3>
<h3 style="text-align:justify;"><strong><span style="color:#800000;">I would also like to ask our three wonderful trainers to help us in this very first attempt to really start the discussions on this blog by posting any of their materials that they used during the training course with explanations or without them, in English or/and their native languages.
